Assistance Process

Assistance from the PORA CC&R Office and OHOA Office

If you are a HOA homeowner (not on the Board) and need help, you need to do the following:

Please make sure you have read your CC&R's and you are in in compliance.
Discuss your problem with your board.
Try to work out a solution with your board.
Keep written records of all attempts to find a solution to your problem.

: If you not in a HOA and need help, you need to do the following:

Show proof that an intensive effort has been made to resolve the complaint.

Verbally notify the violator of the violation. If the violator is not the homeowner, the homeowner must be contacted to resolve the complaint. Record all contacts. Dealing with a renter or lesser generally will not bring a resolution to the violation. If the non-owner does correct the violation, the homeowner must be notified of the violation and the resolution.

A paper trail record must be kept describing all efforts of the individual Association to resolve the complaint. This record must be kept from the first contact attempted or made.
The paper trail must include a single document listing a dated chronological sequence of events taken by the individual Association to resolve the complaint. This dated sequence of events should not include details, merely refer to separate documents furnished.

The paper trail must include records of phone calls, conversations, correspondence etc. with the violator from the original complaint date to the time when requesting assistance. Items should include:
1. A current copy of the Association's CC&R's as filed with Maricopa county.
2. The original dated Complaint Form
3. The dates and records of all contacts and attempted contacts with the violator.
4. All correspondence to and from the violator.
5. The dates and records of all phone calls and attempted phone calls with the violator.
6. The violator's address and phone number of any additional residences. The following websites will be very useful:

7. The violator's attitude concerning the violation and resultion.
8. The single document chronology described above.
9. Include any other documentation that may be useful.
An Association Officer must present all documentation to the OHOA office in the PORA building after the attempts by the individual Association have failed to resolve the violation. The OHOA Officer will review the completeness of the documentation prior to referring the unresolved violation to the PORA CC&R office for assistance.

The PORA office of the CC&R’s is always willing to give any Association Officer advice concerning the pending resolution of a violation. The PORA office of the CC&R’s will encourage conversation between the parties involved during the individual Associations ongoing investigation. The CC&R department is available to consult with either party to help develop a compatible resolution.

The CC&R office hours in the PORA building are Mon – Fri, 9 AM to Noon.
